GTC – General Terms and Conditions for Digital Content
1. Scope of Application
These General Terms and Conditions (GTC) apply to all contracts for the provision of digital content (e.g. studies, white papers, workshop results) that are concluded between BAMAC Group GmbH (hereinafter referred to as ‘Provider’) and users via our website www.bamacgroup.com.
2. Contractual Partner
The contract is concluded with:
BAMAC Group GmbH
Petersgarten 18A, 53773 Hennef
E-mail: info@bamacgroup.com
Register court: Local court Siegburg
Register number: HRB 10053
3. Subject Matter of the Contract
The provider makes digital content available – including studies, analysis results, workshop documentation and comparable materials – which can be obtained either free of charge or for a fee.
4. Conclusion of Contract
The presentation of content on the website does not constitute a legally binding offer, but an invitation to submit an offer.
A contract is concluded when the user completes the order and receives a confirmation by e-mail.
5. Rights of Use
By purchasing the content, the user receives a simple, non-transferable right of use for his/her own purposes. Passing on, duplication or commercial use is not permitted without express written authorisation.
6. Prices and Terms of Payment
If content is subject to a charge, the prices stated on the website at the time the contract is concluded shall apply. Payments are made using the payment methods offered.
7. Delivery of Digital Content
Delivery is made by e-mail, download link or via access to a protected user area. Access is usually activated immediately after receipt of payment.
8. Right of Cancellation
In the case of digital content, the right of cancellation expires as soon as performance of the contract has begun, i.e. when the user has actively consented to the download or provision (Section 356 (5) BGB).
9. Liability
The provider is only liable in cases of intent or gross negligence. The provider accepts no liability for any decisions or measures taken by the user on the basis of the content.
10. Data Protection
Information on the handling of personal data can be found in the privacy policy.
11. Final Provisions
German law shall apply. The place of jurisdiction is the registered office of the provider, provided the user is a merchant. Should individual clauses of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
